ProComm Performance Lab is a professional communication-performance consulting practice serving international organizations and career executives, with specialized focus on the BPO, contact center, and customer-experience (CX) sectors. We provide acoustic diagnostics, supervisory calibrations, executive presence coaching, and corporate retainers.
Nothing contained on this Site constitutes legal, financial, medical, or formal employment advice. Accessing this Site or utilizing interactive simulators does not in itself create a binding client-consultant relationship. Professional consulting engagements commence exclusively upon the mutual execution of a formal, bilateral Client Service Agreement.
3. Eligibility
The Site is intended exclusively for business professionals, corporate decision-makers, and adult career candidates. You must be at least 18 years of age to submit consultation inquiries, diagnostic assessments, or purchase digital toolkits through the Site.
4. Intellectual Property Rights
The ProComm brand, logo, emblem, proprietary 6-Stage Communication Framework (Diagnose → Identify → Develop → Simulate → Score → Improve), diagnostic scorecards, phonetic calibration rubrics, training modules, and digital materials are the exclusive intellectual property of Danilo Pierre / ProComm Performance Lab and are protected under Dominican and international copyright, trademark, and unfair competition laws.
- Permitted Use: You may view, download for internal reference, and utilize digital deliverables strictly within your personal or organizational business operations.
- Prohibited Actions: You may not republish, distribute, resell, sub-license, reverse-engineer, train competing artificial intelligence models on, or publicly represent our frameworks and scorecards as your own without prior express written consent.
5. Digital Products & Store Purchases
When purchasing digital playbooks, toolkits, or assessment packages through our online store:
- Currency & Pricing: All prices are displayed and billed in U.S. Dollars (USD) unless explicitly stated otherwise.
- Delivery: Digital assets are delivered electronically via secure download links dispatched instantly upon payment confirmation.
- Refund Policy: Due to the immediate, irrevocable nature of digital intellectual property delivery, all sales of digital downloads are final once delivered. If a file is materially corrupted or defective, please contact info@procommperformance.com within 7 calendar days of purchase for a replacement or resolution.
6. No Guarantee of Specific Business Results
Communication performance, QA score trajectory, call de-escalation efficiency, and executive interview outcomes are directly contingent on individual commitment, rigorous practice, internal management compliance, and market variables beyond our control. ProComm Performance Lab does not make representations or warranties regarding specific QA score percentage increases, revenue gains, promotional advancements, or employment offers resulting from the use of Site content, digital playbooks, or general methodologies.
7. Limitation of Liability
To the fullest extent permitted by the laws of the Dominican Republic, ProComm Performance Lab and Danilo Pierre shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of, or inability to use, this Site or its digital resources.
Our total cumulative liability for any claim arising out of your use of the Site or purchase of digital products shall be strictly limited to the amount actually paid by you for the specific digital product in the twelve (12) months preceding the claim.
8. Governing Law & Dispute Resolution
These Terms of Use and any disputes arising from or relating to the use of this Site shall be governed by and construed in accordance with the substantive laws of the Dominican Republic. Any legal action or proceeding shall be brought exclusively before the competent judicial courts of Santo Domingo, Distrito Nacional, Dominican Republic.
